Liability Insurance

 

1 Legal Back Ground: -

 

Tort: beach or infringement of:

     1. Nuisance/ Negligence → Rights to his / her Person.

     2. Trespass → Rights to his / her Property.

     3. Defamation → Rights to his / her Reputation.

 

2. Vicarious Liability:-

While the person who is actually responsible for the commission of a tort is always liable, sometimes another person may be liable although he has not actually committed it. This is the doctrine of vicarious liability, and the greatest area of this type of liability is that of master (employer) and servant (employee).

 

1. A principal is liable for the torts of his agents committed within the scope of authority.

 

2. Employer is responsible for what happens to an employee during the course of employment.

 

Public Liability

 

Covers: -

Employer (Insured) for liability due to:

 

1. Death or bodily injury to 3rd party (No Family Workers)

 

2. Accidental damage to 3rd party Property.

 

Liability can be caused by:-

1. Employer.

2. Employee.

3. Defected Property.

4. During Work.

5. Transit.

6. Plant and Property.

 

Public Liability may be Extended to include:-

1. Away Risk – Affecting 3rd Party.

2. Defective Sanctuary Installations – Affecting 3rd Party.

3. Fire and Explosions – Affecting 3rd Party.

4. Lifts and Hoists.

5. Sports and Social Ext.

6. Food and Drink. 

 

Exclusion

 

The Company shall not be liable under this Policy in respect of:

1. injury to any person under a contract of service or apprenticeship with the insured where the injury arises out of and in the course of such person's employment or service with the insured or for compensation claimed from the insured by an injured person or dependent under any Workmen's Compensation Act or Ordinance or similar Legislation.

 

2. Loss of or damage to property:

 

(a) Belonging to or in charge or under the control of the insured or of any servant or agent of the insured.

(b) Being that part of any goods or land or building or structure on which the insured or any servant or agent of the insured is or has been working and caused directly by such work.

(c) Caused by or resulting from fire.

(d) Being railway rolling stock.

 

3. Injury or damage caused by or in connection with or arising from:

 

(a) explosion

(b) accident by any vessel or craft

(c) any lift elevator escalator crane or power hoisting machine.

(d) the ownership or possession or use by or on behalf of the insured of any vehicle (including any type of machine on wheels or on caterpillar tracks) licenses for road use, vessel or craft or the loading or unloading thereof or the delivery or collection of goods in connection with such ownership or possession or use

(e) foreign or deleterious matter in or poisoning caused by food or drink

(f) flood fumes or pollution

(g) defective sanitary installation

(h) any advice or treatment given or administered by the Insured or by any person acting on his behalf

(I) the action of anything administered to any person or animal by the Insured or by any person acting on his behalf

(j) any goods or container thereof sold or supplied or repaired or renovated or let on hire or handled by the Insured and no longer in the Insured's possession or control

(k) animals, except a dog

 

4. damage to any property or land or building caused by subsidence or vibration or by the removal or weakening of support

 

5. Liability assumed by the Insured by agreement unless such liability would have attached to the Insured notwithstanding such agreement

 

6. any sum which the Insured would have been entitled to recover from any party but for an agreement between the Insured and such party.

 

7. (a) compensation for damages in respect of Judgments delivered or obtained in the first instance otherwise than by a Court of competent jurisdiction within the Territorial Limits stated in the Schedule

    (b) costs and expenses of litigation recovered by any claimant from the Insured which are not incurred in and recoverable in the Territorial Limits stated in the Schedule

 

8. loss, damage, cost or expenses or injuries directly or indirectly occasioned by, happening through or in consequence of war, invasion acts of foreign enemies, hostilities ( whether war be declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation or nationalization or requisition, or destruction of or damage to property by or under the order of any government or public or local authority.

 

9. loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting form or in connection with any act of terrorism regardless of any other cause or event contributing concurrently or in any other sequence to the loss

For the purpose of the Exclusion an act of terrorism means an act, including not limited to the use of force or violence and/or there threat thereof, of any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organization(s) or government(s), committed for political, religious, ideological, or similar purposes including the intention to influence any government and/or to put the public, or any section of the public, in fear.

This policy also excludes loss, injury, damage, cost, or expense of whatsoever nature directly or indirectly caused by, resulting from, or in connection with any action taken in controlling, preventing, suppressing or in any way relation to any act of terrorism.

If the Company alleges that by reason of this Exclusion, any loss, injury, damage, cost or expense is not covered by this policy the burden of proving the contrary shall be upon the Insured.

In the event that any portion of this Exclusion is found to be invalid or unenforceable, the remainder shall remain in full force and effect.

 

10. any liability, loss, damage, cost or expense caused by, arising out of or related in any way, directly or indirectly to:

      (a) (I) erasure, destruction, corruption misappropriation, misinterpretation of "data"

           (II) erroneously creating, amending, entering, deleting or using "data"

           Including any loss of use arising therefrom.

      (b) the distribution or display of "data" by means of an Internet Website, the Internet, the Intranet, Extranet, or similar device or system designed or intended for electronic communication of "data".

"Data" means representations of information or concepts in any form,

NOTE: It is not the intention to exclude the perils of Riots, Strikes, Lock-outs and/or Labour Disturbances or Civil Commotion and/or Malicious Damage.

 

11. (a) loss or destruction of or damage to any property whatsoever or any loss or expense whatsoever resulting or arising therefrom or any consequential loss

      (b) any legal liability of whatsoever nature

     directly or indirectly caused by or contributed to by or arising from:

      (I)ionizing radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel

      (II) the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof.

 

12. (a) Personal injury or bodily injury or financial loss or loss of, damage to, or loss of use of property, directly or indirectly arising out of the discharge, dispersal, release or escape of pollutants.

      (b) The cost of removing, nullifying or cleaning of pollutants.

      (c) Fines, penalties, punitive or exemplary damages arising, directly or indirectly, out of the discharge , dispersal, release or escape of pollutants.

Notwithstanding the foregoing, this Insurance shall cover liability otherwise excluded under paragraphs (a) and (b) above, which:

      (I) is caused by a sudden, identifiable, unintended and unexpected happening which takes place in its entirely at a specific time and place, and

      (II) is indemnified in not more than one annual period of original insurance.

If this policy extends to cover operations located within the U.S.A and/or Canada, the following exclusions are applicable to those territories only:

      (d) Personal injury or bodily injury or financial loss or loss of, damage to, or loss of use of property , directly or indirectly arising out of the actual, alleged or threatened discharge, dispersal, release or escape of pollutants:

          (I) at or from premises owned, rented or occupied by an Insured.

          (II) at or from any site or location used by or for the Insured or others for the handling, storage, disposal, processing or treatment of waste.

          (iii) which are at any time transported, handheld, stored, treated, disposed of or processed as waste by or or for an insured or any person or organization for whom the insured may be legally responsible.

          (iv) at or form any site or location on which an insured or any contractors or sub contractors working directly or indirectly on behalf of an insured are performing operations.

 

(1) if the pollutants are brought on or to the site or location in connection with such operations; or

 

(2) if the operations are to test for, monitor, clean up, remove, contain, treat, detoxify or neutralize the pollutants.

 

(e) any loss, cost or expense arising out of any governmental direction or request that an insured test for, monitor, clean up, remove, contain, treat, detoxify or neutralize pollutants.

 

(f) Fines, penalties punitive or exemplary damages arising, directly or indirectly, out of the discharge, dispersal, release or escape of pollutants.

 

For the purpose of this clause ''Pollutants'' means any solid, liquid, gaseous or thermal irritant or contaminant, including but not limited to smoke, vapor, soot, fumes, acid, alkalis, chemicals and waste. Waste includes materials to be recycled, reconditioned or reclaimed.

 

13. any ultimate loss related to or arising from any actual or alleged liability for any legal remedy of any kind whatsoever ( including but not limited to damages, interest, mandatory or other injunctive relief, statutory orders or penalties, legal or other costs, or expenses of any kind) in respect of actual or threatened loss, damage, cost or expense directly or indirectly caused by, resulting from, in consequence of or in any way involving asbestos or any materials containing asbestos in whatsoever form or quantity.

This Exclusion applies whether or not there are one or more other causes ( whether covered or not) that contribute concurrently or in any sequence to the occasioning of the loss, damage, cost or expense. 

 

14. loss, damage or any loss or expense whatsoever or any consequential loss resulting therefrom directly or indirectly caused by or contributed to by or arising in relation to the failure of any non-computer equipment or computer equipment or system for processing storing or retrieving data computer software computer media microchip integrated circuit or similar device whether the property of the Insured or not and whether occurring before or during or after the year 2000

 

    (I) correctly to recognize any date as its true calendar date

    (II) to capture save or retain and/or correctly to manipulate interpret or process any data or information or command or instruction as a result of treating any date otherwise than its true calendar date

    (III) to capture save retain or correctly to process any data as a result od the operation of any command which has been programmed into any computer software being a command which causes the loss of data or the liability to capture save retain or correctly to process such data on or after any date.

    (IV) relating to any change alteration or modification involving the date change to the year 2000 or any other dare change including leap year calculations to any such computer system hardware programme or software or any microchip integrated circuit or similar device in computer equipment or non-computer equipment.

 

15. (I) any liability, loss, damage, cost or expense arising out of, resulting from, caused by, contributed to, or in any way related to the existence, inhalation or exposure to any "fungus/fungi" and/or "spore(s)"; or

      (II) any cost or expense associated in any way, or arising out od the abatement, mitigation, remediation, containment, detoxification, neutralization, monitoring, removal, disposal, or any obligation to investigate or assess the presence or effects of any "fungus/fungi" and/or "spore(s)"; or

      (III) any obligation to share with or repay any person, organization or entity, related in any way to items (I) and (II) above.

Regardless of any other cause, event, material, product and/or building component that contributed concurrently or in any way sequence to the injury or damage.

For the purposes of this Exclusion, the following definitions apply:

 

"Fungus/Fungi" includes but is not limited to, any form or type of mould, mildew, mushroom, yeast or biocontaminent.

"Spore(s)" includes but is not limited to, any substance produced by, emanating from, or arising out of any "fungus/fungi".

 

16. any liability, loss, damage, cost or expense directly or indirectly arising out of, resulting from, caused by or contributed to by Genetically Modified Organisms (GMO's)

 

For the purposes of this Exclusion, the term Genetically Modified Organisms (GMO's) shall mean and include:

      (I) organisms or micro-organisms or cells, or the organisms or micro-organisms or cells or cell organelles, from which they have been derived, which have been subject to a genetic engineering process which resulted in their genetic change.

      (II) every biological or molecular unit with self replication potential, or biological or molecular unit with self replication potential from which they have been derived, which has been subject to a genetic engineering process which resulted in its genetic change.

In the event that the definition of GMO under the applicable laws and/or official regulations relating to genetic engineering or modification in any province, state, territory or jurisdiction in which a claim is made is wider than the foregoing then such wider definition shall be incorporated into this definition in addition to the foregoing.

This Exclusion applies regardless of any other contributing or aggravating cause or event that contributes concurrently or in any way sequence to the loss, damage, cost or expense.

 

17. (1) any liability, loss, damage, cost or expense arising out of resulting from, caused or contributed to by:

 

            (a) Transmissible Spongiform Encephalopathies (hereafter referred to as "TSE");

            (b) Exposure to TSE, or

            (c) Exposure to any item that is known or suspected to cause, contribute to or enable TSE;

 

       (2) the cost of abatement, mitigation, removal or disposal of feed, feed additives or animals, or of any premises or equipment handling such items, as a result of any known or suspected connection between such items and TSE; or

 

       (3) any costs related to a person's abatement, mitigation or removal of, or testing, medical monitoring, medical costs or cure for TSE.

 

This Exclusion includes:

       (a) any supervision, instructions, recommendations, warning or advice given or which should have been given in connection with the above; and

       (b) any obligation to share damages with or repay someone else who must pay damages because of such injury or damage.

 

This Exclusion applies regardless of any other contributing or aggravating cause or event that contributes concurrently or in any way sequence to the loss, damage, cost or expense.

 

18. any liability, loss, damage or expense directly or indirectly caused, contributed or aggravated by, arising out of or related in any way to:

The exposure to an electromagnetic field and/or electromagnetic radiation however caused or generated.

Particularly, this Exclusion applies but is not limited to:

        (a) The consequence of disease or any other disturbance (whether physical or non-physical) in human beings

        (b) There interference with technical equipment , infrastructure and/or operations

        (c) A diminution of the value or property.

In these Exclusions the express "vessel or craft" shall include any vessel craft or thing made or intended to float on or in or travel on or through water or air.
